12. Do Not Track Disclosures
Third parties such as advertising networks, analytics providers, and widget providers may collect Personal Information about your online activities over time and across different websites when you access or use our services. Currently, various browsers offer a “Do Not Track” option, but there is no standard for how “Do Not Track” should work on commercial websites. Due to the lack of such standards, the Site does not respond to Do Not Track consumer browser settings.

These Terms of Use are entered into by and between you and River Baby LLC (“we” or “Us”). These Terms of Use, together with Website Privacy Policy - River Baby LLC.docx, set forth the terms and conditions (collectively, these “Terms”) that apply to your access and use of our website, located at riverbabybirth.com (the “Site”).

Subject to the following section which provides that disputes are to be resolved through small claims court, to the extent that small claims court does not have jurisdiction over any lawsuit or court proceeding, you and we agree to submit to the exclusive personal jurisdiction of the state courts and federal courts located within New York, New York, for the purpose of litigating all such disputes.
12. Dispute Resolution.
In the interest of resolving disputes between you and us in the most expedient and cost-effective manner, you and we hereby agree to resolve disputes in small claims court if a claim is within such court’s jurisdiction, provided that such action may not be transferred, removed or appealed to a different court. Notwithstanding any of the above, you agree that either party may seek injunctive or other equitable relief in any state or federal court having jurisdiction to grant such relief. You hereby expressly waive a trial by jury. You hereby agree not to participate in a class action for any claims covered by these Terms. This provision shall survive the termination of these Terms.
